Protect Your Life & Your Wallet: ACA, Medicare & Life Insurance for Business Owners

Many business owners insure their commercial trucks and physical offices but neglect the most valuable asset in the entire company: themselves. Uncover how to legally deduct your health premiums and leverage living benefits under strict IRS rules.

The Brain Behind Your Security: OnPoint Insurance Advisor

In this episode, host José Delgado alongside co-hosts Natalie Montilla and Wendy Acosta welcomed Ismael Maldonado, founder of OnPoint Insurance Advisor. Ismael exposed a silent killer of small business profitability: poorly structured health insurance and missing tax deductions.

If you are paying health insurance premiums out of pocket, you might be triggering the dreaded Obamacare subsidy trap, or losing thousands of dollars in deductions on your S-Corp W-2 payroll.

1. The Obamacare "Subsidy Trap" (Form 1095-A vs Form 7206)

As Ismael explained, many sole proprietors estimate their income at $40,000 to qualify for major Premium Tax Credits (Obamacare). But if the business performs outstandingly and makes $100,000, the IRS clawbacks the subsidy on the tax return.

The Shield: Through IRS Form 7206, we can deduct 100% of those health premiums directly, lowering your taxable Net Income and softening the blow of the subsidy repayment.

2. The $10,000 S-Corp W-2 Trap

For owners of an S-Corp, the rules are highly technical. To claim this above-the-line deduction, the corporation MUST establish the plan. If you pay premiums from a personal account, the S-Corp has to reimburse you, and that reimbursement **must appear in Box 1 of your W-2** at year-end. If your accountant misses this, the deduction is disqualified.

3. Medicare & Living Benefits (A Modern Safe Haven)

Additionally, voluntary Medicare premiums (Parts B, C, D) qualify for this deduction as a self-employed individual. And on the protective side, modern life insurance with Living Benefits allows you to access cash while alive in the case of critical illnesses like cancer or heart attacks.

Frequently Asked Questions

Can I deduct Medicare premiums under my business?

Yes. Voluntary Medicare premiums for Parts B, C, and D paid for yourself, your spouse, or dependents are eligible for the self-employed health insurance deduction on Form 7206.

How does the "Spousal Eligibility Trap" work?

If you were eligible to enroll in a subsidized health plan offered by your spouse's employer for any given month, you cannot claim the business health deduction for that specific month, even if you rejected their plan.

Are S-Corp owners treated differently than LLC Sole Props?

Yes. >2% S-Corp shareholders must have the policy paid/reimbursed by the S-Corp, and the premium amount must be reported as taxable wages on their W-2 (Box 1), though it remains exempt from FICA taxes.
